1. Company Overview

Steadfast Storm Shelters ("Steadfast," "Company," "we," "us," or "our") provides storm shelter products, delivery coordination, installation services, and related support. Services may include steel and concrete storm shelters, above-ground and underground installations, delivery, site coordination, permitting assistance, and customer support.

Steadfast may coordinate work performed by third-party manufacturers, transportation providers, and installers.

2. SMS Terms & Conditions

By providing your mobile phone number and voluntarily opting in, you agree to receive SMS (text) messages from Steadfast Storm Shelters regarding:

  • Appointment scheduling

  • Customer service

3. Estimates, Pricing & Scope of Work

All pricing provided verbally, electronically, or in writing is an estimate unless explicitly stated otherwise in a signed agreement.

Final pricing may change due to, but is not limited to:

  • Delivery distance or access limitations
  • Site conditions (soil, slope, rock, utilities, obstructions)
  • Permit or inspection requirements
  • Manufacturer pricing changes
  • Lead time changes
  • Installation complexity
  • Customer-requested changes
  • Weather delays
  • Equipment requirements

Only the final written estimate or invoice governs the scope and price of work.

No verbal statements or assumptions are binding.

4. Deposits, Payments & Non-Refundable Costs

Deposits may be required prior to ordering, delivery, or installation.

Deposits become non-refundable once manufacturing, material procurement, delivery scheduling, or installation coordination has begun.

Final payment is due according to the approved estimate or invoice.

Failure to remit payment may result in suspension of delivery or installation.

5. Delivery, Installation & Scheduling

All delivery and installation timelines are estimates only and are not guaranteed.

Delays may occur due to:

  • Weather
  • Ground conditions
  • Manufacturer delays
  • Equipment availability
  • Site readiness
  • Transportation issues
  • Acts of God
  • Circumstances beyond our reasonable control

Customer is responsible for ensuring the site is accessible, safe, and ready before delivery or installation.

6. Site Conditions, Utilities & Access

Customer is solely responsible for:

  • Ensuring underground utilities have been properly located and marked
  • Providing adequate access for delivery trucks and equipment
  • Disclosing known underground or surface hazards

Steadfast is not responsible for delays, damages, or additional costs caused by undisclosed site conditions or inadequate access.

7. Driveways, Landscaping & Surface Damage

Storm shelter delivery and installation often require heavy trucks, trailers, cranes, forklifts, skid steers, or other equipment.

Customer understands this equipment may cause damage including, but not limited to:

  • Cracked driveways
  • Sunken driveways
  • Concrete damage
  • Yard rutting
  • Landscaping damage
  • Sidewalk damage
  • Irrigation damage
  • Surface damage caused by heavy equipment

Steadfast is not responsible for damage resulting from the normal operation or weight of delivery and installation equipment.

Protective measures or alternative installation methods may be available and may result in additional charges.

8. Permits, Codes & Compliance

Unless expressly stated in writing, the customer is responsible for obtaining all required permits, inspections, approvals, and ensuring compliance with local building codes.

Permit requirements vary by jurisdiction and may affect installation methods, placement, scheduling, or pricing.

9. Manufacturer Warranties & Product Responsibility

Storm shelters sold by Steadfast are manufactured by third-party manufacturers.

Any warranties relating to:

  • Materials
  • Construction
  • Structural integrity
  • FEMA compliance
  • ICC-500 compliance
  • Product defects

are provided solely by the manufacturer unless expressly stated otherwise in writing.

Steadfast makes no additional warranties, express or implied.

10. Third-Party Contractors & Services

Steadfast may coordinate services performed by independent manufacturers, transportation providers, installers, contractors, or subcontractors.

While we make reasonable efforts to work with reputable providers, Steadfast is not responsible for delays, workmanship, defects, failures, or damages caused by independent third parties.

11. Customer Responsibilities

Customer agrees to:

  • Provide accurate property information
  • Ensure the installation site is ready
  • Communicate access limitations
  • Disclose known hazards
  • Review and approve estimates before work begins

Failure to do so may result in additional costs, delays, or rescheduling fees.

12. Cancellations

Orders may not be canceled once:

  • Materials have been ordered
  • Manufacturing has begun
  • Delivery has been scheduled
  • Installation has been scheduled

Cancellation requests are subject to review and may result in forfeiture of deposits and reimbursement of costs already incurred.

13. Limitation of Liability

To the fullest extent permitted by law:

Steadfast shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

Total liability for any claim shall not exceed the amount actually paid by the customer for the specific product or service giving rise to the claim.

14. Force Majeure

Steadfast shall not be liable for delays or failures resulting from circumstances beyond our reasonable control, including but not limited to:

  • Severe weather
  • Natural disasters
  • Tornadoes
  • Flooding
  • Fires
  • Supply chain disruptions
  • Labor shortages
  • Government actions
  • Utility outages
  • Transportation delays

15. Electronic Acceptance

Submission of a website form, approval of an estimate, payment of a deposit, scheduling of service, or electronic signature constitutes acceptance of these Terms & Conditions.

16. SMS Program Changes

Steadfast Storm Shelters reserves the right to modify, suspend, or discontinue its SMS messaging program at any time.

Any updates to these SMS Terms & Conditions will be posted on this page with a revised effective date.

17. Governing Law & Venue

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Alabama without regard to its conflict of law provisions.

Any legal action arising from these Terms & Conditions shall be brought in a court of competent jurisdiction located within the State of Alabama.

18. Entire Agreement

These Terms & Conditions, together with any written estimate, invoice, proposal, signed agreement, or other written contract between the parties, constitute the entire agreement between Steadfast Storm Shelters and the customer and supersede all prior communications, discussions, negotiations, representations, or agreements relating to the services provided.
